1. Who we are
SAMAWATT SA ("SAMAWATT", "we", "us") is a Swiss company providing Trading-as-a-Service for renewable energy assets. We are the data controller for personal data processed through this website.

Because we are based in Switzerland but serve customers across the EU, EEA and United Kingdom, this policy is written to meet the Swiss Federal Act on Data Protection (revDSG) and the EU and UK General Data Protection Regulation (GDPR) together. Where the two differ, we apply the stricter standard.
2. What we collect
This website does not offer user accounts or a login. We collect the information you submit through our forms and may retain relevant contact and enquiry details in our business contact management systems to respond to your requests and manage prospective customer relationships. If you opt in to marketing emails, we also record your subscription preferences and evidence of your consent.
Information you give us. When you submit our contact form we receive your name, company, email address, an optional phone number, the reason for your enquiry and your message. When you request a report or use the revenue calculator, we additionally receive your first and last name, company, optional role and phone number, and the asset details you entered — asset type, capacity, market, and the resulting indicative revenue figures.
Those asset details are commercially sensitive. We treat them as confidential business information, use them only to prepare a response or proposal for you, and never share them with other customers or publish them.
Information collected automatically. Our servers keep standard technical logs — IP address, browser and device type, requested page, referring page and timestamp. These exist for security, abuse prevention and diagnosing faults, not for profiling you.
Analytics. If, and only if, you press Accept on our cookie banner, we load Google Analytics 4 with IP anonymisation enabled. If you press Decline, or simply ignore the banner, no analytics script is ever loaded and no analytics cookie is ever set.
We do not use tracking pixels, advertising networks, session recording, heat mapping or social media trackers. Our web fonts are served from our own servers, so loading a page sends no request to Google Fonts.
3. Why we use it, and our legal basis
Enquiries and business relationships. We use your contact details and the information you submit to respond to enquiries, deliver requested reports or calculator results, and discuss potential services. For enquiries made on behalf of a business, we rely on our legitimate interest in responding to business requests and managing prospective customer relationships. Where you personally request steps necessary before entering into a contract with us, we rely on those pre-contractual steps.
Email marketing. With your consent, we use your name, email address, company and stated interests to send relevant SAMAWATT market insights, product updates and event invitations. Marketing consent is optional and separate from submitting an enquiry or requesting a report or calculator result. You can withdraw it at any time.

We do not make automated decisions about you that produce legal or similarly significant effects. Our forecasting and trading algorithms operate on energy market and asset data, not on personal data.
4. Who we share it with
We do not sell your personal data or share it for other organisations' own marketing. We use service providers for website hosting, analytics, business contact management and email delivery. Providers processing personal data on our behalf act under our instructions and are subject to contractual data protection and confidentiality obligations.

We may also disclose data to professional advisers such as lawyers and auditors, or to a public authority where the law requires it. If our business is ever restructured or acquired, personal data may transfer as part of that transaction, and this policy continues to apply until you are told otherwise.
5. International transfers
The European Commission and the Swiss Federal Council recognise each other's data protection regimes as adequate, so data moving between Switzerland and the EEA needs no additional safeguard.
Transfers to processors in the United States are protected by the European Commission's Standard Contractual Clauses together with their Swiss and UK addenda, supported by encryption in transit and contractual limits on onward disclosure. You can request a copy of the safeguards we rely on by writing to our privacy contact.
6. How long we keep it
- Enquiries that do not lead to a business relationship: up to 24 months, so we can pick up the conversation if you come back.
- Enquiries that become a customer relationship: for the life of that relationship, then as required by Swiss commercial and tax law, generally ten years.
- Server logs: up to 12 months.
- Analytics data: up to 14 months, the shortest retention Google Analytics offers.
- Marketing contact details: up to 24 months of inactivity, then deleted or anonymised unless you have engaged with a communication in that time.
We retain your marketing contact details for as long as necessary to provide the communications you have subscribed to. We stop using them for marketing when you unsubscribe, withdraw your consent, or we establish that your email address is invalid.
We periodically review our marketing records and remove information that is no longer necessary for this purpose. We may retain a minimal record of your unsubscribe request to prevent further marketing emails.
When a retention period ends we delete the data or irreversibly anonymise it.
7. Your rights
Under both Swiss and EU law you can ask us to do any of the following, free of charge, and we will respond within 30 days.
- Access — get a copy of the personal data we hold about you.
- Rectification — have inaccurate or incomplete data corrected.
- Erasure — have your data deleted where we have no overriding obligation to keep it.
- Restriction — ask us to pause processing while a dispute is resolved.
- Portability — receive your data in a structured, machine-readable format.
- Objection — object to processing based on our legitimate interests, including any direct marketing.
- Withdraw consent — at any time, without affecting anything done before you withdrew it.
To exercise any of these, write to privacy@samawatt.com. We may ask you to confirm your identity before we act, so that we do not disclose your data to somebody else.
If you think we have handled your data badly, please tell us first — we would rather fix it. You also have the right to complain to the Swiss Federal Data Protection and Information Commissioner (FDPIC) in Bern, to the supervisory authority of your EU member state, or to the Information Commissioner's Office in the United Kingdom.
You can unsubscribe from marketing emails at any time using the unsubscribe link in each email or by contacting us at the privacy contact listed in this policy. Withdrawal does not affect the lawfulness of processing carried out before it. If you object to the use of your personal data for direct marketing, we will stop that use, including any related profiling. You may still receive non-marketing communications necessary to handle your requests or provide agreed services.
8. How we protect it
The whole site is served over TLS. Access to form submissions is limited to the SAMAWATT staff who need it, protected by multi-factor authentication. Our infrastructure runs on hardened, access-controlled systems, and API credentials are held as server-side secrets that never reach your browser.
No system is perfectly secure. If a breach ever puts your rights at serious risk, we will notify you and the competent authority as the law requires.
9. Cookies
We set no cookies of our own. The only entry we store without asking is a note of your own cookie choice, kept in your browser. Analytics cookies appear only after you accept. This section lists every entry we store, in full, and explains how to change your mind.

That is the complete list. We use no advertising cookies, no social media trackers, no session recording and no cross-site profiling.
If you have not answered the banner, or you pressed Decline, no analytics script is loaded and no analytics cookie exists. The only thing stored is your choice itself, once you make one. Our web fonts are compiled into the site and served from our own servers, so loading a page sends no request to Google Fonts. We embed no videos, maps or social widgets that could set cookies behind our back.
You can withdraw consent at any time by clearing this site's data in your browser. In Chrome, Edge, Firefox and Safari this sits under site settings or privacy settings for the individual site. Doing so deletes the stored choice and any analytics cookies, and the banner will appear again on your next visit so you can answer differently. You can also block or delete cookies for all sites in your browser settings, or install Google's official opt-out browser add-on. Blocking the strictly necessary entry only means we ask you about cookies on every visit.
10. Links to other sites
Our pages link to sites we do not control, including our own AI advisor at SAMAWATT.ai and market data sources such as the ENTSO-E Transparency Platform. Once you follow such a link, that site's own privacy policy governs what happens to your data. We are not responsible for their practices.
11. Children
SAMAWATT sells to energy businesses. Our services are not directed at children, and we do not knowingly collect data from anyone under 16. If you believe a child has sent us personal data, contact us and we will delete it.
12. Changes to this policy
We update this policy when our practices or the law change, including if we ever add a cookie. The date at the top always reflects the current version. If a change materially affects your rights, we will make it prominent rather than quietly editing the page.
