The rules for using this website, and the limits of what the figures on it promise.

In short: this covers the website only. Our trading service runs on a separate signed contract. Nothing here is investment advice, and every revenue figure on this site is an estimate, not a promise.

1. What these terms cover

These terms are an agreement between you and SAMAWATT SA, Route de Crassier 7, 1262 Eysins, Switzerland. They govern your use of http://127.0.0.1:3000 and everything published on it.

They do not govern our trading, forecasting or optimisation services. Those are provided only under a separately negotiated and signed service agreement. Where that agreement and these terms disagree, the signed agreement wins. Nothing on this website constitutes an offer capable of acceptance, and browsing it creates no trading relationship.

By using the site you accept these terms. If you do not accept them, please stop using the site.

2. No investment, financial or trading advice

This is the most important clause on the page, so we have put it near the top.

Nothing on this website is investment advice, financial advice, trading advice or a recommendation to buy, sell or hold any commodity, security or contract. We are not acting as your adviser, broker or fiduciary when you read these pages.

Every number our revenue calculator produces is an indicative estimate generated from the assumptions you enter and from historical market data. It is not a quote, not a forecast of your actual revenue, and not a promise of any result. Real outcomes depend on market prices, weather, asset availability, grid conditions, regulation and your own contractual position, none of which we control.

The same applies to case studies, performance figures and market commentary published here. Past performance does not predict future results. Energy markets can move sharply and against you. Take your own professional advice before making any decision based on what you read here.

3. Using the site

You may browse the site, and download or print material for your own internal business evaluation. In return, please do not:

  • Scrape, harvest or systematically extract content, or place unreasonable load on our infrastructure.
  • Attempt to gain unauthorised access to any part of the site, our APIs or our systems.
  • Republish substantial parts of the site commercially without our written permission.
  • Submit false information, or somebody else's personal data, through our forms.
  • Use the site for anything unlawful, or in breach of applicable sanctions or export controls.

4. Intellectual property

The site's design, text, graphics, software and the SAMAWATT name and logo are owned by us or our licensors and protected by Swiss and international law. We grant you a limited, revocable, non-exclusive licence to view and use the site as described above. No other right is granted, and nothing here transfers ownership of anything.

You may quote short extracts with clear attribution and a link back to the source page.

5. Market data and third-party sources

Some pages display electricity market data from external sources, including the ENTSO-E Transparency Platform, Bundesnetzagentur | SMARD.de and Fraunhofer ISE, the latter published under CC BY 4.0. That data belongs to its providers and remains subject to their own terms and licences.

Market data is shown for information only. It may be delayed, incomplete, revised or unavailable, and we give no warranty as to its accuracy or timeliness. Do not rely on it for trading decisions.

6. Forward-looking statements

Statements about expected performance, market development, capacity under management or our own plans are forward-looking. They reflect what we believe today and are subject to risks and change. We are under no obligation to update them, and you should not treat them as guarantees.

7. Availability and no warranty

The site is provided as is and as available. We work to keep it accurate and online, but we do not warrant that it will be uninterrupted, error free, secure, or that any content is complete or current. We may change, suspend or withdraw any part of it at any time without notice.

To the fullest extent the law allows, we exclude all implied warranties, including fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the fullest extent permitted by Swiss law, we are not liable for indirect, incidental, special or consequential loss, nor for lost profits, lost revenue, lost trading opportunities, lost data or business interruption arising from your use of this website or reliance on its content.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights are unaffected.

We link to third-party sites, including our AI advisor at SAMAWATT.ai, which operates under its own terms and privacy policy. Links are provided for convenience and are not an endorsement. We are not responsible for the content, availability or practices of any site we do not control.

11. Changes to these terms

We may update these terms from time to time. The version published here, dated at the top, is the one that applies. Continuing to use the site after a change means you accept the updated terms.

12. Governing law and jurisdiction

These terms are governed by the substantive law of Switzerland, without regard to its conflict of law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.

The ordinary courts at our registered seat in the Canton of Vaud, Switzerland have exclusive jurisdiction over any dispute, subject to any mandatory place of jurisdiction that protects consumers.

If a court finds any provision unenforceable, the rest of these terms stay in force.
